These Terms of Service ("Terms") govern your use of the Pool Care+ mobile application ("the app"), provided by Zac Lippard, an independent developer ("we," "us"). By creating an account or using the app, you agree to these Terms.
The Service
Pool Care+ helps you log pool water test results, track chemical levels over time, receive chemical dosage recommendations, scan test strips using your device's camera, chat with an AI pool assistant, and schedule maintenance reminders.
Not a Substitute for Professional Judgment
Chemical dosage recommendations, AI test strip analysis, and AI assistant responses are provided for informational purposes to help you maintain your pool. They are estimates based on the data you provide and are not a substitute for your own judgment, your test equipment's instructions, or advice from a licensed pool professional. Always follow the safety instructions on chemical product labels. Handle pool chemicals carefully. Never mix chemicals directly with each other, and keep them away from children. You are solely responsible for how you use any recommendation the app provides.
Accounts
You need an account to use most features of the app. You're responsible for keeping your login credentials secure and for all activity under your account. You must be at least 13 years old to create an account.
Subscriptions and Billing
Pool Care+ offers optional paid subscription tiers (currently Skim, Lap, and Dive) in addition to a free tier. Subscription prices are shown in the app and on our pricing page and may vary by region.
Auto-renewal: Subscription payment will be charged to your Apple App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to at purchase (subject to any price change notice required by Apple or Google). You can manage or cancel your subscription at any time in your Apple ID account settings or Google Play subscription settings. Cancelling does not refund the current billing period, and you'll keep access to paid features until the end of the period you already paid for.
Refunds are handled by Apple or Google according to their respective policies, not directly by us.
Acceptable Use
Don't use the app to violate any law, attempt to disrupt or reverse-engineer the service, or upload content that infringes someone else's rights or is unlawful, abusive, or harmful.
Disclaimer of Warranties
The app is provided "as is" without warranties of any kind, express or implied. We don't guarantee the app will be uninterrupted, error-free, or that AI-generated recommendations will always be accurate.
Limitation of Liability
To the maximum extent permitted by law, Zac Lippard is not liable for any indirect, incidental, or consequential damages arising from your use of the app, including damages related to pool equipment, water chemistry outcomes, or chemical handling decisions made using information from the app.
Changes to These Terms
We may update these Terms as the app changes. Continued use of the app after an update means you accept the revised Terms.
Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles.
